V decembri na\u0161a susedn\u00e1 obec Igram bola ur\u010den\u00e1 na vykonanie pozemkov\u00fdch \u00faprav v praxi a pr\u00e1ve v t\u00fdchto d\u0148och sa objavuj\u00fa inform\u00e1cie o podmienkach a praktick\u00fdch inform\u00e1ci\u00e1ch.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Samozrejme, \u017ee je to roben\u00e9 form\u00e1lnou formou citovan\u00edm r\u00f4znych paragrafov a odstavcov z\u00e1kona, ktor\u00fd k tomu prin\u00e1le\u017e\u00ed. Oznamy m\u00f4\u017eete n\u00e1js\u0165 na webov\u00fdch str\u00e1nkach obce Igram, ale napr. aj \u010cataj. V okrese Senec je e\u0161te ur\u010den\u00e9 na sce\u013eovanie e\u0161te Bernol\u00e1kovo a v okrese Pezinok s\u00fa \u0160enkvice.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Je v\u0161eobecne ka\u017ed\u00e9mu jasn\u00e9, \u017ee t\u00e1to ni\u010d nehovoriaca forma u dotknut\u00fdch \u013eud\u00ed nen\u00e1jde patri\u010dn\u00fa odozvu a iba m\u00e1lokto sa aj akt\u00edvne zapoj\u00ed do re\u00e1lneho v\u00fdkonu pozemkov\u00fdch \u00faprav a \u013eudia sa zobudia pr\u00edli\u0161 neskoro a niektor\u00fdm bude scelovanie pozemkov proti ich v\u00f4li<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">O \u010do vlastne ide je vysvetlen\u00e9 v n\u00e1le\u017eit\u00fdch dokumentoch a d\u00f4vodov\u00e1 spr\u00e1va je sn\u00e1\u010f ka\u017ed\u00e9mu jasn\u00e1. V praxi to znamen\u00e1, \u017ee jeden vlastn\u00edk by mal teoreticky vlastni\u0165 ucelen\u00fa plochu pozemku v jednej v\u00fdmere na svojej vlastnej novovytvorenej \u010dasti katastr\u00e1lneho \u00fazemia obce Igram. Ur\u010dite s\u00fa aj obyvatelia \u010cataja, ktor\u00fd maj\u00fa dnes pozemky v Igrame a t\u00fdch sa t\u00e1to pozemkov\u00e1 \u00faprava bude t\u00fdka\u0165.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Doposia\u013e je n\u00e1m v\u0161etko jasn\u00e9 a zrozumite\u013en\u00e9. V\u0161etky d\u00f4vody s\u00fa praktick\u00e9 a naozaj pom\u00f4\u017eu pri neskor\u0161om hospod\u00e1ren\u00ed, prenaj\u00edman\u00ed, deden\u00ed, alebo predaji pozemku vlastn\u00edka. V\u0161etky argumenty ukazuj\u00fa, \u017ee scelovan\u00edm by mal vlastn\u00edk r\u00f4znych rozdroben\u00fdch pozemkov s viacer\u00fdmi majite\u013emi, ktor\u00ed s\u00fa dnes fyzicky dosiahnute\u013en\u00ed, z\u00edska\u0165 jeden ucelen\u00fd pozemok a to by malo by\u0165 \u00faplne v poriadku.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Len\u017ee niektor\u00ed vlastn\u00edci s\u00fa dnes nezn\u00e1mi, nedosiahnute\u013en\u00ed alebo niektor\u00ed z nich u\u017e aj dlh\u00fa dobu ne\u017eij\u00faci a tu nast\u00e1vaj\u00fa probl\u00e9my.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ot\u00e1zka je v\u0161ak aj kde a ako dostane vlastn\u00edk uveden\u00fa zocelen\u00fa p\u00f4du v katastri Igramu. Je jasn\u00e9, \u017ee viac bud\u00fa hodnoten\u00e9 p\u00f4dy v bl\u00edzkosti obce, ktor\u00e9 sa nesk\u00f4r m\u00f4\u017eu sta\u0165 stavebn\u00fdmi pozemkami a men\u0161iu hodnotu bude ma\u0165 pozemok niekde pri dia\u013enici, alebo \u00faplne na konci katastra. Tu je d\u00f4le\u017eit\u00fd poznatok z u\u017e prebiehaj\u00facich pozemkov\u00fdch \u00faprav v in\u00fdch katastroch : pri pridelen\u00ed pozemku v ur\u010ditej lokalite (napr. lep\u0161ej z poh\u013eadu v\u00fdhodnej polohy v r\u00e1mci vyu\u017eite\u013enosti v bud\u00facnosti)  sa prihliada na to, \u010di majite\u013e p\u00f4du obhospodaruje. Je to d\u00f4le\u017eit\u00e9 z poh\u013eadu vlastn\u00edkov p\u00f4dy vo v\u00fdhodnej\u0161\u00edch katastr\u00e1lnych \u00fazemiach, v bl\u00edzkosti intravil\u00e1nu obce, alebo pr\u00edstupu na nov\u00fa pridelen\u00fa p\u00f4du po pozemkovej \u00faprave.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">To s\u00fa zrejme ot\u00e1zky, ktor\u00e9 pri sce\u013eovan\u00ed bud\u00fa ob\u010danov Igramu najviac zauj\u00edma\u0165 a dnes z nich asi nikto nevie pod\u013ea ak\u00e9ho k\u013e\u00fa\u010da sa toto sce\u013eovanie bude vykon\u00e1va\u0165.<\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"948\" height=\"552\" src=\"https:\/\/www.cataj.eu\/wp-content\/uploads\/2023\/02\/poz-upravy.jpg\" alt=\"\" class=\"wp-image-1635\" srcset=\"https:\/\/www.cataj.eu\/wp-content\/uploads\/2023\/02\/poz-upravy.jpg 948w, https:\/\/www.cataj.eu\/wp-content\/uploads\/2023\/02\/poz-upravy-300x175.jpg 300w, https:\/\/www.cataj.eu\/wp-content\/uploads\/2023\/02\/poz-upravy-768x447.jpg 768w\" sizes=\"auto, (max-width: 948px) 100vw, 948px\" \/><figcaption class=\"wp-element-caption\"><em>ilustra\u010dn\u00e9 foto<\/em><\/figcaption><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Nezn\u00e1mi vlastn\u00edci<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Popri rozdrobenosti pozemkov na Slovensku je zrejme druh\u00fdm najv\u00e4\u010d\u0161\u00edm probl\u00e9mom pr\u00e1ve existencia nezn\u00e1mych vlastn\u00edkov pozemkov. V&nbsp;z\u00e1sade ja jedn\u00e1 o&nbsp;probl\u00e9m s&nbsp;nedostato\u010dnou evidenciou pozemkov z&nbsp;minulosti. Ide o vlastn\u00edkov, ktor\u00ed m\u00f4\u017eu \u017ei\u0165 v&nbsp;danej obci alebo inde na Slovensku, len nevedia o&nbsp;tom, \u017ee vlastnia pozemky a&nbsp;naj\u010dastej\u0161ie ide u\u017e o&nbsp;m\u0155tve osoby (kedy ich dedi\u010dia nevedia, \u017ee pozostal\u00ed vlastnili pozemky). Nezn\u00e1my vlastn\u00edci s\u00fa zveren\u00ed do spr\u00e1vy Slovensk\u00e9ho pozemkov\u00e9ho fondu (alebo Lesov SR, pokia\u013e ide o&nbsp;lesn\u00e9 pozemky). Slovensk\u00fd pozemkov\u00fd fond by mal chr\u00e1ni\u0165 ich vlastn\u00edctvo, z\u00e1ujmy a&nbsp;hospod\u00e1rne naklada\u0165 s&nbsp;ich pozemkami. Tu je zauj\u00edmav\u00e1 skuto\u010dnos\u0165, \u017ee o svoj pozemok m\u00f4\u017eete pr\u00eds\u0165 ak u\u017e ne\u017eij\u00faca osoba je vlastn\u00edkom p\u00f4dy ( a neprebehlo dedi\u010dsk\u00e9 konanie) a scelovan\u00edm sa dan\u00fd pozemok v katastri obce strat\u00ed, lebo bude nahraden\u00fd scelen\u00fdm pozemkom in\u00e9ho vlastn\u00edka.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">E\u0161te raz zopakujeme: Nezn\u00e1my vlastn\u00edk je nezn\u00e1mym pre nedostato\u010dn\u00fa evidenciu pozemkov z&nbsp;minulosti, ke\u010f pozemok je evidovan\u00fd len menom a&nbsp;priezviskom, bez d\u00e1tumu narodenia alebo pobytu osoby. \u010casto ide o&nbsp;osoby u\u017e ne\u017eij\u00face, ktor\u00fdch pozemky neboli prededen\u00e9 pr\u00e1ve preto, \u017ee sa o&nbsp;nich nevedelo pre ne\u00faplnos\u0165 identifika\u010dn\u00fdch \u00fadajov. Ak by dedi\u010dia alebo aj samotn\u00fd nezn\u00e1my vlastn\u00edk si chceli pozrie\u0165, \u010di vlastnia v&nbsp;niektorom katastr\u00e1lnom \u00fazem\u00ed pozemok, mohli by  pred pozemkov\u00fdmi \u00fapravami zada\u0165 do katastr\u00e1lneho port\u00e1lu meno a&nbsp;priezvisko a&nbsp;vlastn\u00edctvo si preverili.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Po pozemkov\u00fdch \u00faprav\u00e1ch v\u0161ak u\u017e \u017eiadna tak\u00e1to kontrola nebude mo\u017en\u00e1. Jedin\u00e1 mo\u017enos\u0165 bude dopytova\u0165 sa Slovensk\u00e9ho pozemkov\u00e9ho fondu, \u010di boli vyplaten\u00e9 financie ako n\u00e1hrada za podiely nezn\u00e1meho vlastn\u00edka. O&nbsp;tejto mo\u017enosti v\u0161ak m\u00e1lo \u013eud\u00ed vie a je&nbsp;tie\u017e omnoho n\u00e1ro\u010dnej\u0161ia. Dedi\u010d bude odk\u00e1zan\u00fd na ochotu zamestnancov Slovensk\u00e9ho pozemkov\u00e9ho fondu, ktor\u00fd nem\u00e1 na vybavenie \u017eiadosti \u017eiadnu lehotu. Plynut\u00edm \u010dasu tie\u017e nevedno zaru\u010di\u0165, kde a&nbsp;ako sa financie pou\u017eij\u00fa, \u010di neprejd\u00fa v&nbsp;prospech \u0161t\u00e1tneho rozpo\u010dtu. Asi v\u0161etci vieme, \u017ee t\u00e1to mo\u017enos\u0165 m\u00e1 minim\u00e1lnu \u0161ancu na \u00faspe\u0161n\u00e9 konanie.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">F<strong>inan\u010dn\u00e9 vyrovnanie.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Pozemkov\u00e9 \u00fapravy v&nbsp;sebe obsahuj\u00fa aj jednu zauj\u00edmav\u00fa mo\u017enos\u0165 \u2013&nbsp;<strong>finan\u010dn\u00e9 vyrovnanie.<\/strong>&nbsp;To znamen\u00e1, \u017ee ak m\u00e1 niektor\u00fd vlastn\u00edk spolu v&nbsp;danom katastr\u00e1lnom \u00fazem\u00ed v\u00fdmeru pozemkov&nbsp;<strong>men\u0161iu ako 400 m2<\/strong>, s&nbsp;jeho s\u00fahlasom nemus\u00ed po novom dosta\u0165 u\u017e \u017eiadny pozemok, ale len finan\u010dn\u00e9 vyrovnanie. Toto m\u00f4\u017ee by\u0165 naozaj v\u00fdhodn\u00e9 pre vlastn\u00edkov, ktor\u00ed vlastnia napr. len 50 m2. Ak by mal vlastn\u00edk vy\u010dlenen\u00fdch 50 m2, ide o&nbsp;v\u00fdmeru, ktor\u00fa nie je zmyslupln\u00e9 obhospodarova\u0165. Tu sa v\u0161ak pre uveden\u00fa mo\u017enos\u0165 rozhodne samotn\u00fd vlastn\u00edk.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Ako samotn\u00e1 \u00faprava prebieha<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Nariadenie konania sa ozn\u00e1mi vyhl\u00e1\u0161kou celej obci, ktorej sa konanie t\u00fdka, a&nbsp;aj t\u00fdm susedn\u00fdm, nako\u013eko sa \u00fapravy vykon\u00e1vaj\u00fa pod\u013ea mo\u017enosti naraz v&nbsp;celom katastr\u00e1lnom \u00fazem\u00ed. Predch\u00e1dza\u0165 by mu malo pr\u00edpravn\u00e9 konanie, kde sa zis\u0165uj\u00fa postoje a&nbsp;z\u00e1ujem vlastn\u00edkov, ktor\u00fdch sa \u00fapravy bud\u00fa t\u00fdka\u0165.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Najv\u00e4\u010d\u0161\u00edm kame\u0148om \u00farazu pri t\u00fdchto \u00fakonoch je pr\u00edpadn\u00e1 nevysporiadanos\u0165 pozemkov. Vlastn\u00edcke vz\u0165ahy musia by\u0165 vyrie\u0161en\u00e9 a&nbsp;zdokumentovan\u00e9, aby sa dalo takpovediac pohn\u00fa\u0165 \u010falej. Tu je potrebn\u00e9 vyzva\u0165 v\u0161etk\u00fdch dedi\u010dov, ktor\u00ed e\u0161te nemaj\u00fa vysporiadan\u00e9 dedi\u010dsk\u00e9 pr\u00e1va, aby tak ur\u00fdchlene urobili, lebo po scelen\u00ed pozemkov u\u017e bude neskoro. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">N\u00e1sledne sa zverejn\u00ed register p\u00f4vodn\u00e9ho stavu, ka\u017ed\u00fd vlastn\u00edk dostane v\u00fdpis o&nbsp;pozemkoch, ktor\u00e9 bud\u00fa \u00faprav\u00e1m podlieha\u0165, podaj\u00fa sa pr\u00edpadn\u00e9 n\u00e1mietky. V&nbsp;tomto \u0161t\u00e1diu je na rade projekt pozemkov\u00fdch \u00faprav; vlastn\u00edci m\u00f4\u017eu op\u00e4\u0165 poda\u0165 n\u00e1mietky. Tie sa n\u00e1sledne rie\u0161ia na pozemkov\u00fdch \u00faradoch \u2013 najprv na obvodnom, v&nbsp;pr\u00edpade potreby aj na krajskom. Br\u00e1ni\u0165 sa v\u0161ak mo\u017eno aj \u0161tandardnou \u017ealobou.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Po vysloven\u00ed s\u00fahlasu u\u017e spom\u00ednan\u00fdch dvoch tret\u00edn vlastn\u00edkov sa prist\u00fapi k&nbsp;schv\u00e1leniu a&nbsp;vykonaniu projektu. N\u00e1sledne by malo vznikn\u00fa\u0165 Ob\u010dianske zdru\u017eenie vlastn\u00edkov pozemkov. Zdru\u017eenie po registr\u00e1cii sa riadi svojimi stanovami a vzniknut\u00e1 spr\u00e1vna rada zdru\u017eenia sa z\u00fa\u010dast\u0148uje  procesu scelovania v s\u00fa\u010dinnosti s n\u00e1le\u017eit\u00fdmi org\u00e1nmi \u0161t\u00e1tnej spr\u00e1vy. Nie je tajomstvom, \u017ee v\u00fdber spr\u00e1vnych \u010dlenov do spr\u00e1vnej rady je podmienkou spokojnosti v\u0161etk\u00fdch vlastn\u00edkov pozemkov.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Zhotov\u00ed sa rozde\u013eovac\u00ed pl\u00e1n a&nbsp;na jeho z\u00e1klade sa zazna\u010dia predmetn\u00e9 zmeny do katastra nehnute\u013enost\u00ed. Posledn\u00fdm krokom je re\u00e1lne vyt\u00fd\u010denie nov\u00fdch hran\u00edc v&nbsp;ter\u00e9ne.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Ako je vidie\u0165 mnohorakos\u0165 vlastn\u00edctva je v\u00fdrazne negat\u00edvnym faktorom, je v\u0161ak mo\u017en\u00e9 ju aspo\u0148 do istej miery eliminova\u0165. Je na to v\u0161ak potrebn\u00fd \u010das, v&nbsp;neposlednom rade peniaze a&nbsp;z\u00e1rove\u0148 sa treba zmieri\u0165 s&nbsp;t\u00fdm, \u017ee neexistuje takzvan\u00fd ide\u00e1lny stav, v&nbsp;ktorom by sa dala dosiahnu\u0165 v\u0161eobecn\u00e1 spokojnos\u0165. T\u00e1 nie je mo\u017en\u00e1 nikdy a&nbsp;pri tejto t\u00e9me to plat\u00ed dvojn\u00e1sobne. Ur\u00fdchlene si vysporiadajte svoje pozemky v r\u00e1mci dedi\u010dsk\u00e9ho konania, zistite si skutkov\u00fd stav, \u010di niekde nem\u00e1te zabudnut\u00fa p\u00f4du, neprededen\u00fa po svojich predkoch. A hlavne si dajte z\u00e1le\u017ea\u0165 na obozn\u00e1men\u00ed sa s problematikou, lebo nie je jednoduch\u00e1 a skr\u00fdva v sebe ve\u013ea ot\u00e1zok, ktor\u00e9 rad\u0161ej v tomto \u010dl\u00e1nku nebudeme uv\u00e1dza\u0165. V\u0161\u00edmajte si postup sce\u013eovania v obciach, ktor\u00e9 s\u00fa v na\u0161ej bl\u00edzkosti, menovite : Igram, Bernol\u00e1kovo a \u0160enkvice.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Na internete je dos\u0165 inform\u00e1ci\u00ed o u\u017e prebiehaj\u00facich, alebo dokon\u010den\u00fdch pozemkov\u00fdch \u00faprav\u00e1ch v r\u00f4znych obciach na Slovensku (napr\u00edklad Vrbov\u00e9). Tam sa d\u00e1 n\u00e1js\u0165 ve\u013ea pou\u010dn\u00e9ho a vnesie V\u00e1m to svetlo do uvedenej problematiky.
